Just weeks after a Pulaski County judge dismissed Bryan Norris’ election lawsuit – over procedural issues – the Secretary of State candidate has filed a new complaint. This time, his attorney included the required affidavit that was cited as missing in the earlier ruling. Read more below.
Court documents filed April 27th show Norris has refiled his election contest against the Saline County Board of Election Commissioners and opponent Kim Hammer, again challenging the handling of the March 31st Republican primary runoff. The new filing follows an April 9th decision by Circuit Judge Timothy Davis Fox, who dismissed the original lawsuit without prejudice (meaning the suit could return) after finding it failed to meet statutory requirements, including the absence of a required affidavit.
The updated complaint mirrors many of the same allegations previously reported by MySaline, including claims that ballot boxes were not properly sealed, and that Norris’ designated representative – attorney Clint Lancaster – was not allowed to observe the recount within the legally required distance.
The filing also reiterates claims that at least one election worker did not take the required oath and that state election officials present failed to enforce election laws during the recount process.
In the newly submitted affidavit, dated April 27, 2026, Norris states under oath that he believes the alleged irregularities are “serious,” widespread, and render the election results “tainted, untrustworthy, and unverifiable.” He further asserts that the issues raise concerns not only about the recount, but about the integrity of the original runoff election itself.
Norris is again asking the court to declare the election results invalid and to order a new runoff election in Saline County. The lawsuit comes after recounts in multiple counties – including Saline – matched original machine totals, and after the initial case was dismissed on procedural grounds without the court considering the underlying allegations.
As of now, the case has been refiled but not yet ruled on. MySaline will continue to follow developments.
